How to file a complaint against the police

Police hurt the rights of many individuals and the sad thing are people don’t even know how to file complaints on police. But now I Vishal Saini Advocate will make it easier for you all to file a complaint against the police if the police have violated your right.

Yes, you can complain against the police?   You must be wondering how to file a complaint against the police.

There are two ways to file a complaint on police that are given as below:-

  1. Filling of complaint via legal experts/ or advocate:– The advocates/legal experts have knowledge of every field of law so they can also site valid legal points in complaint application or in case so it has been observed that the complaint itself makes a lot of difference and the higher official will work on that complaint as per law.
  2. Self-filling of Complaint: If you still want to file yourself you can also do it. It can be done after following the steps mentioned as below:-

Documents required to file a complaint against the police:-

  • If an injury or harm has happened to you or any ur relatives/friends due to the police then mention the medical report in the complaint itself
  • You can submit a photo that shows the injury of the victim  and must remember to annexure that photo  like {annexure 1, Annexure 2, Annexure 3 etc )
  • If you have lodged your complaint in any local police station and have not got any response from the police then you can attach a copy of that complaint also.
  • Proof of daily diary report entry {if any}

The process to file Complaint Against Police Officer:-

  • The complaint process is offline/Online so you have both options either to file a complaint in your own handwriting or make it in soft copy form and send it via email/Whatsapp to the Higher officers.
  • The following basic information should be mentioned while making a complaint against the police
  1. Full Name of the complaint.
  2. Address {either temporary or permanent } of the complaint.
  3. Contact details {Including mobile number, email etc )  of the complaint.
  4. Write each and every fact about the complaint- what happened, How happened and when happened. {try to explain date, day time etc).
  5. The name of the officer /position of Police officer, police officer batch number { who have done wrong to you }  and in what police station he/she is posted against you want to file a complaint.
  6. What was said or done or not done by the police officer basically the reason,
  7. If anyone was a witness name it but remember if you have any video recording, audio recording   ( make sure you mark them as annexure also).

All of this needed to be sent to the police complaint authority or the Highest police officer of your state some are the details for you to help you to file a complaint to the police

It is desirable to explain that you can also file a Civil suit for damages on the police.

To file a civil suit for damages one needs to issue notice first then damages can be claimed from that suit. You can get this case drafted by your advocate after complying with all procedures of CPC,

Complaint against police in Kerala

As per data from the Government of Kerala, PCA headquarters at Thiruvananthapuram. Its office will be the office of the Deputy Secretary to government nominated as the secretary of the state-level police complaints authority.

The following Points Need to be noted-

  • If after filing a complaint, you don’t get any response (it happens) then you can File the RTI also
  • you can read this article on how to file RTI
  • In the RTI application, there will be a reply from their side.
  • Then further suggested to go for FIR and file FIR against a such police officer.
  • If the police don’t do an FIR you can file a case for a status report and you can ask for status from the police via courts
  • After all, these action police will hopefully launch FIR and your problem will be solved.
